JOUSSE (Daniel). Traité de la justice criminelle de France. À Paris, chez Debure père, 1771. 4 volumes in-4, 17-(1)-lxxi-(une blanche)-837-(une blanche) + 8-848 +7-(une blanche)-843-(une blanche) + 6-792 [mal chiffrée 297] pp, glazed brown marbled calf, spine ribbed with partitions and fleurons with garnet-colored title-pieces, filleted edges, red edges; one false-title missing and 3 with cut-outs in the place of an old bookplate (period binding). FIRST EDITION ONE OF THE GREATEST JURISCONSULTES OF THE ANCIEN REGIME, CLOSE TO THE LUMIERES, DANIEL JOUSSE (1704-1781) was one of the few among his colleagues to take an interest in all branches of law. Although he remained a councillor at the Presidial Court of Orléans, he was concerned about his independence and refused to occupy higher positions which would have required more docility from him. He nevertheless led a vast reflection on French law, which he disseminated widely by publishing numerous treatises and commentaries. The main concepts of this far-reaching theoretical work can be found in the 1804 Civil Code and the 1810 Penal Code. In touch with the great minds of his time, he showed a broad curiosity for other fields, such as science and history, and published a work on the sphere and two works on the Orléanais region.
